  • Under Virginia equitable distribution principles, the negative impact of marital fault can be considered. And the fault need not be the basis for the final divorce. To be a valid consideration, however, the marital fault must be relevant to one of the statutory factors listed in Va. Code Ann. § 20-107.3(E). Though equitable distribution is not a vehicle to punish behavior, the statutory guidelines authorize consideration of such behavior as having an adverse effect on the marriage and justifying an award that favors one spouse over the other. In other words, while equitable distribution should not degenerate into a witch hunt for marital misconduct, there should still be legally enforceable rules of conduct for spouses during the marriage.

Dillard v. Commonwealth

Facts:

Defendant was convicted in the Circuit Court of Fairfax (Virginia) of driving under the influence and reckless driving. He appealed.  The appellate court held the offenses of which defendant was convicted were covered by § 19.2-294.1, under which, when he was convicted of one of the charges, the remaining charge had to be dismissed if the offenses grew out of the same act or acts.  The trial court erred in determining, as a matter of law, that he could be convicted for both driving under the influence and reckless driving for his continuous, uninterrupted course of operation of a motor vehicle.

  • The two offenses subject to Va. Code Ann. § 19.2-294.1, driving under the influence and reckless driving, are “separate and distinct” violations. Nevertheless, the legislature intended that a conviction of one offense precludes conviction of the other, whenever both grow from the same continuous, uninterrupted course of operation of a motor vehicle. Thus, the statute is applicable where the two offenses grow out of the same act or acts of driving. It is the commonality of the underlying offending conduct, the continuous, uninterrupted operation of a motor vehicle that invokes the preclusive effect of the statute.

Facts:

Defendant was convicted of possession of alcohol by a minor under Va. Code Ann. § 4.1-305 (1950) (amended). Defendant appealed the conviction for underage possession of alcohol in Fairfax.  The court found the evidence presented by and testimony of the state trooper to be credible and convincing. The court held there was sufficient evidence of possession because when, as here, the commission of the crime had been fully confessed by the accused, only slight corroborative evidence was necessary to establish the corpus delicti. The court held the odor of alcohol on the minor defendant’s breath provided the necessary corroboration.

Davidson v. Commonwealth

Facts:

The Circuit Court of Fairfax, Virginia, convicted defendant of grand larceny and denied his motion to set aside the verdict on his contention that the Commonwealth failed to prove that the victim possessed the allegedly stolen property. Defendant appealed.  The appellate court found that the indictment did not provide defendant sufficient notice to adequately prepare to defend the accusations made against him. Amendments to the embezzlement statute changed the law so as to prohibit a conviction for larceny upon an indictment for larceny and proof of embezzlement. The general assembly intended the current version of Va. Code Ann. § 18.2-111 to preclude conviction under an indictment for larceny on proof of embezzlement. Therefore, proof of embezzlement did not support defendant’s conviction under the indictment alleging larceny.

  • Va. Code Ann. § 46.2-882 provides in part that the speed of any motor vehicle may be checked by the use of radar. The results of such checks shall be accepted as prima facie evidence of the speed of such motor vehicle in any court or legal proceeding where the speed of the motor vehicle is at issue. In any court or legal proceeding in which any question arises about the calibration or accuracy of any radar device as defined in § 46.2-882 used to check the speed of any motor vehicle, a certificate, or a true copy thereof, showing the calibration or accuracy of the speedometer of any vehicle or of any tuning fork employed in calibrating or testing the device, and when and by whom the calibration was made, shall be admissible as evidence of the facts therein stated. No calibration or testing of such device shall be valid for longer than six months.

  • In the context of a dissolution of marriage action, cruelty consists of anything that tends to bodily harm and thus renders cohabitation unsafe or involves danger of life, limb or health.
  • Constructive desertion occurs in a marriage where the conduct of the other spouse has caused conditions in the marital home to be intolerable to the point that the affected spouse has to leave.
  • Actual desertion requires both an actual breaking off of the marital cohabitation and an intent to desert in the mind of the offender. Reasons to refuse cohabitation other than an intent to desert may justify discontinuance of the relationship without giving rise to grounds for divorce.
