  • Normally, because a finding of fault now has decreased legal significance, a no-fault divorce is usually preferable. However, if the fault ground contributed significantly to the break-up of the marriage, then the divorce should be awarded on the fault ground if proven. The transfer or division of jointly owned marital property, the amount of any monetary award, and the apportionment of marital debts are to be determined after consideration of the factors listed in Va. Code § 20-107.3(E).
