Facts:

Defendant challenged a judgment of the Circuit Court of Fairfax (Virginia), which convicted him of driving under the influence of alcohol (DUI) in violation of Va. Code Ann. § 18.2-266. He argued that the trial court erred in not granting his proffered jury instruction defining “operating a motor vehicle” and by admitting his Department of Motor Vehicle (DMV) record into evidence at the sentencing phase of his trial.
